Morris 57 Circe was custom built in 2008 for a very experienced yachtsman through the collaborative efforts of Morris Yachts , Fontaine Design Group , and her owner and his captain. Exquisitely crafted, Circe was designed for long-distance cruising between New England and the tropics. At 57 feet, she is still easily handled by a couple, yet large enough to accommodate six people in luxurious comfort. Two guest cabins forward and a palatial Owner’s cabin aft make this center cockpit yacht feel like a bigger boat, yet her push-button hydraulics and well-thought-out mechanical systems make sailing and docking a breeze. Extremely well maintained and only sailed by her original owner, Circe is now ready for her new stewards to enjoy their next adventure together.

Circe boasts a classic satin-varnished teak interior. Her bulkheads are teak veneered Meranti marine plywood abutting solid teak rails, stiles, corner posts and fiddles. The overhead throughout the boat is made with custom fiberglass white V-groove panels supported by custom varnished teak battens.

Main Salon/Nav area

The center cockpit companionway steps lead into the main salon, amid-ship. The steps are teak and finished in crushed walnut shells and varnish for excellent non-skid control. The top and bottom steps are hinged and provide storage. The navigation table with cushioned seat and vessel AC/DC breaker panel and some electronics are to starboard of the stairs. Slightly forward of the Nav desk and outboard are two custom seats separated by a built-in teak table with drawers for storage. Additional storage alcoves and lockers/drawers with cane or solid teak panel doors provide plenty of space for owner gear. Two hull ports surrounded by bright white sheathing provide natural light in this navigation/reading area. The “knockdown” secure cabin sole throughout the boat is satin-varnished teak and maple planking with maple perimeter border. The main salon’s teak table, with folding leaf, is supported by custom polished stainless steel bases. When not dining, the port side settee can be transformed into additional berth by extending the settee’s port side leg inboard 6″.  The centerline settee backrest houses a 23″ flat screen TV that raises and lowers electrically and rotates 180 degrees for optimal viewing. Storage is provided below the centerline seat.

A liquor/wine bar storage cabinet and locker provide ample space for bottles and glasses and are convenient to the main salon table. Additional lockers/cabinets (high and low) with cane paneled doors and flat paneled teak doors are located on the inboard leg of the dinette, adjacent to the main mast.

  The galley is aft and port of the main salon and runs fore and aft. Access to the aft  cabin is through the galley.  A  satin-varnished teak stile and rail door with arched top and flat teak panels separates the Owner’s  cabin from the fore/aft galley area.  A second watertight door aft and inboard of the galley refrigeration provides excellent access for monitoring the engine room while underway.  A generous galley Corian countertop on both sides provide excellent space for food preparation.  The inboard counter includes two single stainless steel sinks with storage above the countertop in two cabinets as well as more space below.  The force 10 (3)-burner stove with SS hood is also mounted on the inboard side of the galley. A generous number of cabinets and drawers provide more than enough space for a very well equipped galley.  An 800 watt Microwave  in the galley as well.

Two large custom refrigeration/freezer units are installed aft and outboard of the galley and include separate Seafrost DC controls and interior temperature gauges.  Custom spice and knife racks and excellent ventilation with opening ports make this the perfect offshore galley layout.  

  Galley Stove

Circe has a Force 10 three-burner propane stove with a thermostatically controlled oven/broiler. The unit is gimbaled to allow it to swing freely when the boat is underway. The stove includes a custom stainless steel stove hood and exhaust fan.

The aft cabin has a centerline king berth flanked by two custom dressing seats to port and starboard. Four drawers are located at the foot of the berth and additional storage is found under the seat cushions. Lots of additional storage; hinged lift up locker tops, two large hanging lockers lined with aromatic cedar; 3 storage shelves behind cane cabinet door panels, as well as a drop-front storage lockers. Just forward of the king-sized berth is a teak bureau with mirror above and five satin varnished teak drawers. Six additional cane paneled lockers are found throughout the cabin. Great storage! 

The cabin is well-ventilated by opening ports in the trunk cabin sides; dorade vents in the overhead; two opening deck hatches and Hella electric fans. Excellent lighting is provided by overhead domes, reading and courtesy lights.  The teak and maple cabin sole runs throughout the cabin and into the private head with separate stall shower. A watertight door opens in the forward shower bulkhead to access the walk-in engine room.

The Owner’s head has Corian counter and sink, teak-framed mirror, electric head and ventilation (with auto lighting) via an exhaust fan. Dome lighting as well as lights at each mirror and near cabin sole at the vanity lockers.

Forward Guest Stateroom

This guest cabin is fitted with a generous sized vberth, built of satin varnished teak surfaces and the solid teak corner posts, rails and stiles found throughout the boat. The berth incorporates a dressing seat with storage beneath the cushion. The aft end of the berth includes four teak drawers for storage. Additional storage areas with cane panels provide more than enough space for guest clothes, bunk linens and blankets. There is one aromatic cedar lined hanging locker in the cabin. Both reverse cycle air conditioning and heat are provided to both guest and Owner’s cabins as well as dedicated Espar heat. The cabin sides are sheathed in white wood strips. The reflective custom fiberglass v grove overhead panels trimmed with varnished teak battens keep the space bright and cheery. Ventilation is provided by opening port lights in the trunk cabin sides, an overhead hatch and by two Hella fans. Three overhead dome lights and two bulkhead mounted reading lights are included as well as courtesy lighting in the aft face of the seat and near the cabin sole.

Engine Room

The engine room is a watertight space accessed from the galley or aft cabin shower. Both doors are aluminum A30 rated watertight doors by Pacific Coast Marine. This engine room was meticulously designed by the yacht’s captain and owner and includes the forethought of “soft patches” in the engine room overhead, making genset or engine removal via the cockpit sole possible. The room is insulated with materials by Novitechniek. Ease of maintenance, access and safety has determined the layout of all equipment in the engine room. Removable insulated panels are located as needed. A removable aluminum grate floor system provides great strength and visibility throughout and the engine room is even fitted with a work bench!

Deck wash system (fresh and salt)

  • Groco C-60 24 volt DC Salt water deck wash automatic, self-priming and corrosion-resistant on-demand pump Delivers up to 6.5 GPM. A 15′ length of self-coiling hose with bib fitting and nozzle connects to the Jabsco stainless steel flush deck fitting.
  • Freshwater wash down connector is installed on the starboard side deck and plumbed directly to the freshwater pressure system. The same 15′ hose length used for saltwater washdowns can be attached at this deck fittings for swimmers needing a rinse!

The engine is a Yanmar, model 4LHA-HTP, (Serial # M26318), 124 horsepower diesel with in-line transmission (ZF45A).  Gear ratio is 2.43:1. It includes an 80-amp alternator and 150-amp 24v alternator. Shaft installation includes stainless steel strut and PSS shaft seal. A shark fin is mounted to protect the shaft strut.  Engine access is excellent with watertight bulkhead doors in galley and Owner’s cabin shower, as well as soft patch in engine room overhead/cockpit sole.  Engine room is insulated with Iso-Cor 3mm cork-rubber dampening sheets and 3M Thinsulate 6710. All insulation is covered with Millennium Metal aluminum panels. Engine room has additional sound dampening via Visco Damp material.  Engine room has 24v exhaust fan to help bring in fresh air for engines and eliminate heat in the room. Engine exhaust is expelled through a wet/dry exhaust system.

Oil Change pump

A Reverso OP-6-24V oil change pump is mounted in the engine room aft and to port of the transmission and provides an efficient way for draining and filling engine oil.

A three-blade Flex-O-Fold propeller is fitted to the shaft. The prop is 24″ x 17″ and includes a tip and donut collar zinc as well as a shaft-mounted line cutter.

Circe has a Simrad AP25-CH-3D autopilot with display mounted at the nav station. A second station is mounted in the cockpit at the helm.  Autopilot is interfaced with both radar and GPS. The autopilot’s CPU is located high on the aft bulkhead of the engine room. A heading sensor (Simrad RC42) is located on centerline under the sole in the aft cabin. An electric linear drive unit and rudder feedback sensor are also included in the system.

Bow Thruster

Circe has a Lewmar 250TT electric 8 KW tunnel bow thruster. The thruster is powered by the 24 volt battery bank and is operated from the helm via a joystick.

A modest cabin is incorporated into the design which contains a day head, a galley with galley with sink, refrigerator and storage space for provisions. The port and starboard settees are carefully designed for lounging or sleeping. Generous storage can be found in the forepeak. An alternative layout converts the forepeak space into a v-berth.

Below deck, "Masquerade" is finished in Herreshoff-style with Mahogany trim and white bulkheads.  A small galley to starboard offers a stainless steel sink with fresh water, a 12v refrigerator and lots of dry storage behind sliding doors.  To port is an enclosed head with manual Raritan toilet (connected to a gravity holding tank),Corian countertop with fresh water and more storage in two drawers and sliders outboard of stainless bowl.  Amid ship are two opposing setees with seating for 6.  A removable tapered pedestal fits into the teak and holy cabin sole socket to mount the high gloss-varnished teak dining table.  A second socket is mounted in the teak cockpit sole if the table is desired there.  When not in use, the table can e stored in its custom canvas bag and stowed.

Two high gloss Mahogany louvered doors close off the space between the main salon and large storage area under the foredeck.  This area is great for storing additional sails/gear or could be finished with a v-berth and cushions if one desired to use the boat for cruising.

HULL -Hand laid composite hull - 2 piece construction (from fiberglass 2-part tooling)

*  Layers of fiberglass and 3/4" structural foam core material are hand laminated and hand-rolled with Hydrex Vinylester resin.

*  Hull is reinforced with two pair of continuous longitudinal structural foam stringers fiber-glassed to the hulls interior.

*  A fiberglass reinforced "L" frame keel floor is laminated into the hull and bunk faces.

*  All major bulkheads are glassed into the hull before it is removed from the mold.  Non-structural bulkheads and furniture are affixed with a 3M urethane adhesive.

*  Additional layers of fiberglass, hull reinforcement and stiffening includes a reinforced fiberglass mast step, engine mounts, chain-plate gussets and a matrix of Marine plywood bulkheads and bunk faces.

DECK -  Reinforced fiberglass foam core, one-piece construction.

*  All deck hardware and deck fittings are drilled, tapped, bedded and thru-bolted completely through the deck using backing plates and/or washers where appropriate.

RUDDER -  The spade rudder is carbon fiber laminated around carbon/epoxy rudder post and an internal reinforcing frame.  An upper stuffing box bearing is installed at the hull penetration and a third bearing supports the top of the rudder post at the deck.

PROPULSION SYSTEM -  Engine

*  Yanmar model 3YM20FC 21 horsepower 3-cylinder freshwater-cooled 4-stroke diesel.

*  Engine hour meter reads approximately 600 hrs.

*  Sail drive/transmission is model SD20 by Yanmar with reduction ratio 2.64 to 1

*  Propeller is a 15" diameter x 10" pitch, left-handed FLEX-O FOLD 2-blade folding prop

Fuel -  The single 12 gallon aluminum diesel tank is located in the starboard cockpit locker and mounted on the forward bulkhead.  The tank is fitted with an inspection port and tied into the bonding system.  There is a WEMA tank sensor and gauge located outboard of the main breaker panel.

Water -  The single 20 gallon polyethylene fresh water tank is located under the aft end of the port settee.  Water is available via a manual hand plunger and faucet on the sink.  The boat has a cockpit shower powered by a Shurflo 12v fresh water pump.  A telescoping shower head with hose and control valve is located in the cockpit line cubby.

Head -  The head is fitted with a raw water Raritan manual toilet and pumps directly into a 20 gallon polyethylene holding tank (gravity).  Alternatively, the discharge thru-hull can be closed and waste can be alternatively extracted through a deck fitting shore-side pump out station.  A 12v Snake River gauge is located on the bulkhead vanity face to check the holding tank level status.

The vessel is equipped with an Isotherm BI 4112 12v DC refrigeration system.  The ice box is lined with stainless steel and has a volume of 41 liters and  utilizes a Danfoss BD35F compressor and the temperature range is 42 degrees F to 5 degrees F.

The Spar was fabricated by Hall Spars and is Carbon fiber with double aluminum spreaders.  Spar is fitted with Leisure furl coastal system mast tracks and fittings.

This vessel is equipped with a 12v DC battery charging system.  The 12v system is energized  from a 12v house battery bank which is charged by a 90 amp engine alternator.

*  Engine Starting Battery -  1 12v starting battery (rated at 800 cranking amps)

*  Solar Panel -  Removable Solar panel plugs into waterproof DC plug that powers a 7 amp battery charge controller and feeds the house battery bank.

*  Main 12v distribution panel is fitted with a BTM panel to provide battery status and includes individual breaker switches for all 12 v functions.

Two Deck Options

The M42 is offered in two deck configurations: the M42 and the M42 ST (short trunk cabin). The M42 ST was added recently to meet the growing demand for a deck layout that combined the look of the M36 with the increased headroom of the M42. The interior layouts for each boat, however, are more or less identical. Please refer to the technical drawings and gallery for images of each of the two models.

Like her smaller sisters the M42 is all about sailing. Sail handling has been thoroughly engineered for simplicity, reliability and ease of use. All control lines, sheets and halyards have been led below deck to control/winch pods in the cockpit within easy reach of the helmsman leaving the deck clean, clear and safe.

Spacious Interior

Three steps down from the cockpit lies a functional, airy cabin with fantastic visibility. Here you will find an open interior plan that maximizes spaciousness. Morris craftsmen finish the interior in classic Herreshoff style with antique white bulkheads and gloss varnished cherry joinery. Cruising cuisine is a snap to prepare in the U-Shaped galley fitted with a two-burner gimbaled stove, luxurious Corian countertops, ample refrigeration and practical storage space. When you turn off the lights, lie in your queen-sized bed and stargaze out through the large overhead hatch. The M42 features a cleverly integrated blackout shade/bug screen on all hatches.

Manufacturer Provided Description

Designed as a serious offshore cruiser with shoal-draft capability, the Morris 36’s lines and weight distribution were computer optimized to provide excellent performance on all points of sail. The boat has a delicate balance of crisp, clean traditional lines and a modern, fast, responsive underbody. To maximize performance, the design offers a transom stern with the added sailing length of a counter stern. There are two keel configurations offered, the standard fin or optional Scheel keel. The bulwarks are a minimum of 5 inches high, providing sure footing when on the foredeck. The cockpit is thoughtfully proportioned combining comfort and protection for the crew. Available with either sloop or cutter rig, the standard 36 has a high aspect ratio masthead rig with shrouds moved well inboard for clean side decks and narrow sheeting angles. Below deck there are a number of interior layouts available. Even if the traditional pilot berth layout is selected, most things in the interior can still be altered. To enhance the stiffness designed into the hull and deck, the designer specifies a matrix of double-bonded preconstructed cabinets and bulkheads fiber-glass bonded directly to the hull and deck with triaxial DBM. The care that goes into every Morris 36 is obviously time consuming, but the result is a yacht built for longevity and to hold her value through the years.

We have owned Fiscal Stray since 1999.  We are the third owner.  Tom Morris, the builder, and Chuck Paine, the designer, set out to provide sailors with a safe boat which can also be competitive – especially on long courses.  They were, in our opinion, successful.  Sailing Magazine’s John Kretschmer reviewed the Morris 36 as a used boat a few years ago.  The review can be found here:  https://sailingmagazine.net/article-576-morris-36.html

We have sailed Fiscal Stray out of Saint Michaels, Maryland around the Chesapeake and North to Maine, Nova Scotia and New Brunswick.  When we went out of the Bay we tended to anchor and enjoy the least popular places.  You can find a description of one of our trips south and one north at www.todsails.com.  Just click where the home page tells you to and select the part you want to read.  We made many trips both north and south but only documented one each so far. 

What follows is an abbreviated description of our 2019 trip to Nova Scotia.  We left St. Michaels on July 2 and headed north.  We made the Coast Guard station at Cape May on 7/4/19.  Going north from Cape May we prefer the outside route but Chris Parker, our SSB radio router told us we needed to be in shelter sooner rather than later.  We sailed to Atlantic Highlands.  The next morning we left when the tides were favorable for the East River..  Heading up Long Island sound we hit Jamestown, RI, went over to Newport,  did some shopping, and left for Marion on 7/11.  We stayed put at Marion YC due to weather.

We left for Ptown and rented a mooring.  We left the mooring at 11:30 and headed for Tenants Harbor where we picked up a mooring and ran into Chuck Paine.  On to Rockland where we provisioned.  We left the mooring at 10:00 and joined our OCC (Ocean Cruising Club) friends for the sail to NS.  We stopped at Lunenburg to check in to Canada. Next stop Halifax and the Royal Nova Scotia Yacht Squadron.  The  OCC cruisers and some boats from the RNSYS then cruised in company.  We had a wonderful time and met many new friends.  We left at 0800 08/06/19  from Shelbourn NS for NE Harbor Maine.  We enjoyed NE Harbor and then Camden.  We then did an OCC cruise stopping at some wonderful anchorages including Maple Juice Cove and the Basin.

We had turned around and headed south.  We had some weather – expected and predicted but anchored with a bit of chain out.  We had some  nice stops: New Bedford, Great Salt Pond, and Essex for example.  We stayed put when weather indicated it was a good idea.  There was a storm on the Atlantic so we stayed on the Sound.  FS then moved from Port Washington to Still Pond – 232 nm in 35 hrs averaging 6.6 knots.  We made it home to St. Michaels on 9/11/19,  Our trip covered 2248 nm and took 71 days.  We spent 2 nights at a dock.  We had done 5 overnights.    

We made numerous trips north and many south to the Bahamas.

A prospective purchaser might be interested in how the boat does racing.  Gust Stringos on Bluebird has done 13 Bermuda races doing single handed races and races where he goes over single handed and sails back double handed. Tom Vander Saln on Yankee Girl (the former Next Boat) has done 8 Bermuda races.  In 2023 Gust did first in class and first in fleet in the single handed class. He has also taken silver in 2017 and 2016.  I don’t have complete records beyond that.  Bluebird has won the Around the Island race on Penobscot Bay with Chuck Paine as crew.  Bluebird has the same keel configuration and stick as Fiscal Stray

Hackers may have stolen your Social Security number in a massive breach. Here's what to know.

A new lawsuit is claiming hackers have gained access to the personal information of "billions of individuals," including their Social Security numbers, current and past addresses and the names of siblings and parents — personal data that could allow fraudsters to infiltrate financial accounts or take out loans in their names. 

The allegation arose in a lawsuit filed earlier this month by Christopher Hofmann, a California resident who claims his identity theft protection service alerted him that his personal information had been leaked to the dark web by the "nationalpublicdata.com" breach. The lawsuit was earlier reported by Bloomberg Law.

The breach allegedly occurred around April 2024, with a hacker group called USDoD exfiltrating the unencrypted personal information of billions of individuals from a company called National Public Data (NPD), a background check company, according to the lawsuit. Earlier this month, a hacker leaked a version of the stolen NPD data for free on a hacking forum, tech site Bleeping Computer reported . 

That hacker claimed the stolen files include 2.7 billion records, with each listing a person's full name, address, date of birth, Social Security number and phone number, Bleeping Computer said. While it's unclear how many people that includes, it's likely "that everyone with a Social Security number was impacted," said Cliff Steinhauer, director of information security and engagement at The National Cybersecurity Alliance, a nonprofit that promotes online safety.

"It's a reminder of the importance of protecting yourself, because clearly companies and the government aren't doing it for us," Steinhauer told CBS MoneyWatch.

In a statement posted to its website, NPD said the breach involved a "third-party bad actor that was trying to hack into data in late December 2023, with potential leaks of certain data in April 2024 and summer 2024."

The company added that it is working with law enforcement and government investigators. NPD said it "will try to notify you if there are further significant developments applicable to you."

Here's what to know about the alleged hack. 

What is National Public Data? 

National Public Data is a data company based in Coral Springs, Florida, that provides background checks for employers, investigators and other businesses that want to check people's backgrounds. Its searches include criminal records, vital records, SSN traces and more information, its website says.

There are many similar companies that scrape public data to create files on consumers, which they then sell to other businesses, Steinhauer said.

"They are data brokers that collect and sell data about people, sometimes for background check purposes," he said. "It's because there's no national privacy law in the U.S. — there is no law against them collecting this data against our consent."

What happened with the USDoD hack?

According to the new lawsuit, USDoD on April 8 posted a database called "National Public Data" on the dark web, claiming to have records for about 2.9 billion individuals. It was asking for a purchase price of $3.5 million, the lawsuit claims. 

However, Bleeping Computer reported that the file was later leaked for free on a hacker forum, as noted above. 

How many people have been impacted?

The number of people impacted by the breach is unclear. Although the lawsuit claims "billions of individuals" had their data stolen, the total population of the U.S. stands at about 330 million. The lawsuit also alleges that the data includes personal information of deceased individuals.

Bleeping Computer reports that the hacked data involves 2.7 billion records, with individuals having multiple records in the database. In other words, one individual could have separate records for each address where they've lived, which means the number of impacted people may be far lower than the lawsuit claims, the site noted.

The data may reach back at least three decades, according to law firm Schubert Jonckheer & Kolbe, which said on Monday it is investigating the breach.

Did NPD alert individuals about the hack? 

It's unclear, although the lawsuit claims that NPD "has still not provided any notice or warning" to Hoffman or other people affected by the breach. 

"In fact, upon information and belief, the vast majority of Class Members were unaware that their sensitive [personal information] had been compromised, and that they were, and continue to be, at significant risk of identity theft and various other forms of personal, social, and financial harm," the lawsuit claims. 

Information security company McAfee reported that it hasn't found any filings with state attorneys general. Some states require companies that have experienced data breaches to file reports with their AG offices. 

However, NPD posted an alert about the breach on its website, stating that it believes the information breached includes names, email addresses, phone numbers, Social Security numbers and mailing addresses.

Can you find out if your data was part of the hack?

There are tools available that will monitor what information about you is available on the dark web, noted Michael Blair, managing director of cybersecurity firm NukuDo. Commonly breached data includes your personal addresses, passwords and email, he added.

One such service is how Hofmann, who filed the lawsuit, found out that his information has been leaked as part of NPD breach.

"Make sure to use reputable companies to look that up," Blair said. 

What should I do to protect my information?

Security experts recommend that consumers put freezes on their credit files at the three big credit bureaus, Experian, Equifax and TransUnion. Freezing your credit is free, and will stop bad actors from taking out loans or opening credit cards in your name. 

"The biggest thing is to freeze your credit report, so it can't be used to open new accounts in your name and commit other fraud in your name," Steinhauer said. 

In its statement, NPD also urged people to put free fraud alerts on their accounts, which "tells creditors to contact you before they open any new accounts or change your existing accounts," it said. You'll have to contact just one of the three credit bureaus to create a fraud alert, and that agency will alert the others.

Steinhauer recommends consumers take several additional steps to protect their data and finances:

  • Make sure your passwords are at least 16 characters in length, and are complex. 
  • Use a password manager to save those long, complex passwords.
  • Enable multifactor authentication, which Steinhauer calls "critical," because simply using a single password to access your accounts isn't enough protection against hackers. 
  • Be on alert for phishing and other scams. One red flag is that the scammers will try to create a sense of urgency to manipulate their victims.
  • Keep your security software updated on your computer and other devices. For instance, make sure you download the latest security updates from Microsoft or Apple onto your apps and devices. 

You can also get a tracking service that will alert you if your data appears on the dark web. 

"You should assume you have been compromised and act accordingly," Steinhauer said.

When Daryl Randall saw convicted real estate fraudster Bert Whalen partying at a Carmel bar late last year, he couldn't believe his eyes.

Randall is among scores of investors across the country who say Whalen defrauded them with the sale of dilapidated Indianapolis homes that he promised to fix up and rent on their behalf. Many of the investors connected with Whalen through his then-business partner Clayton Morris, a former Fox & Friends host with a popular YouTube show about real estate investing.

In all, an IndyStar investigation found, the two men sold more than 700 homes from 2017 to 2019, leaving a trail of lawsuits and disgruntled investors behind them.

The allegations led to an FBI investigation and a federal grand jury in New Jersey indicted Whalen in November of 2019. Federal prosecutors said the crime was part of a " Ponzi scheme " that resulted in millions of dollars in losses for investors nationwide, including in New Jersey.

Whalen pleaded guilty to wire fraud conspiracy in March of 2022. A plea agreement with federal prosecutors called for a prison sentence of 4.25 to 5.25 years.

Whalen's conviction was a relief to his victims. Now, they thought, he wouldn't be able to harm anyone else.

That's why Randall was so confused when he saw Whalen at a local bar ― two years after admitting to fraud.

"He’s out partying his (expletive) off all the time," Randall said. "I've received multiple calls from people who have seen him wining and dining at restaurants. Myself and others want to know: How is this even possible?"

Randall, who operates a construction design business, said he purchased multiple properties from Whalen and paid him for rehab work that was never done. When Randall went to sell the properties, he said he received a massive tax bill for property taxes that Whalen was supposed to have paid.

"This guy has created financial destruction for so many people that trusted in him," Randall said. "We can’t understand why he is walking free as if nothing happened. Does the law not pertain to this person? What's the explanation?"

Court records show Whalen's sentencing has been delayed more than half a dozen times, mostly without any explanation. As a result, Whalen hasn't spent a day in prison, despite his conviction nearly two-and-a-half years ago.

The most recent delay came last week. Whalen is now scheduled to be sentenced Dec. 3 at the federal courthouse in Newark before Judge Madeline Cox Arleo .

Neither federal prosecutors nor Whalen's attorney, John Tompkins, would comment publicly on the unusual string of delays.

One legal expert said the extensions might suggest Whalen is seeking a cooperation deal with federal authorities. Morris, his former business partner, has not been charged with any crime. Morris and his family moved to Portugal in July of 2019 as lawsuits from investors piled up, but recently moved back to the United States after five years overseas.

Whatever the reason, the continued delays are a source of growing frustration for Whalen's victims ― especially since he has been accused of continuing to scam investors while awaiting sentencing.

"What good is being found guilty if they just keep letting you roam freely harming people?" said Cole Peterson, a Wyoming investor who purchased two homes through Morris and Whalen. "That's just the opposite of justice."

How the scheme worked

Peterson's experience was like that of many investors. In 2017, he borrowed money from family members and dipped into his retirement savings to purchase two homes for $94,000, which included the cost of rehabbing the properties. He later discovered the homes were nothing like the nicely renovated turnkey properties Morris featured in his YouTube videos. The carpet was ripped up. Drywall and toilets were missing. One house didn't even have a front door.

The condition of the homes was particularly shocking because Peterson had been provided with a signed leasing agreement and had received rental payments, despite the fact that the home clearly had been uninhabited.

"That’s why I think it was a Ponzi scheme," he said.

Peterson sold one of the homes for a huge loss and spent thousands of dollars to renovate the other one. Morris later settled a lawsuit with Peterson and several other investors, but Peterson said he still lost more than $16,000.

Investors weren't the only ones to suffer. Tenants told IndyStar they endured deplorable conditions in homes owned or managed by Whalen's companies, including sewage-filled basements, dangerous levels of lead exposure and ceilings that came crashing down on occupants.

Whalen, meanwhile, lived in a waterfront home at Geist Reservoir once owned by former Gov. Mitch Daniels. It featured indoor and outdoor pools, a marble foyer, and a private dock. He also kept a 51-foot yacht in Florida that the manufacturer describes as "superbly luxurious."

Despite his apparent wealth, nobody has been able to collect any money from Whalen, Peterson said. And even though federal prosecutors solicited a guilty plea from him, "they haven’t limited his ability to reach his tentacles out and harm people," Peterson said.

In fact, a May 30 complaint from Indiana Attorney General Todd Rokita claims Whalen has continued to victimize people during his lengthy sentencing wait.

Whalen accused of additional fraud

In 2022 and 2023, Whalen used the name "Herb Francis" to obscure his identity as he solicited investors through a new set of limited liability companies, including one called My Bricks and Sticks, according to the complaint . Whalen, whose middle name is Francis, did so without a real estate brokerage license and in violation of his pre-trial release agreement in the criminal case, the complaint says.

In one case, Whalen convinced an Oregon-based investor to purchase two properties for $154,900 and sign property management agreements, but then failed to fix up the properties as promised, according to the complaint.

County health inspections found broken appliances, a roach infestation and a dangerous electrical box at one of the properties. It took five inspections and several months before the problems were addressed. At the second property, a tenant was left without heat and running water, the complaint says, prompting the investor to cancel the management agreements with Whalen's company.

If Whalen had been in prison, the Oregon investor might have avoided the scheme. The purchase agreement for the first property was signed on March 1, 2022, the same day a judge accepted Whalen's guilty plea in New Jersey.

The purchase agreement for the second home and property management agreements for both properties were signed after Whalen's sentencing had been delayed.

Six delays with no explanation

While the sentencing delay last week came with an explanation, the half dozen delays before that did not.

The most recent delay was attributed to the new Indiana Attorney General complaint. A judge issued a default judgment against Whalen and his companies in July. Financial details of the judgment are still being worked out.

As for the previous six delays?

Nobody outside of the U.S. Attorney's Office in New Jersey and Whalen's legal team knows for sure.

The length of the sentencing delay, however, is unusual. After all, some of the highest profile fraud cases in recent history resulted in faster sentencing. Timothy Durham, who was the subject of the largest corporate fraud investigation in Indiana history, was sentenced less than eight months after his 2012 conviction. Bernie Madoff, the nation's best known Ponzi schemer, was sentenced just three months after pleading guilty in 2009.

"The multiple continuances with no explanation are weird," said Patrick Cotter, a former federal prosecutor and longtime white-collar defense attorney. "That’s a lot of unexplained continuances."

One possible explanation, he said, is that Whalen may be cooperating with investigators, or at least trying to reach a cooperation agreement.

"My best guess is that there was a delay because there were negotiations going on to see if a cooperation deal could be reached," said Cotter.

The most obvious target would be Morris, Whalen's high-profile former partner. Although Morris has not been charged with any crime, he is named as a defendant alongside Whalen in a 2020 complaint filed by the Indiana Attorney General alleging deceptive sales practices involving more than 150 properties. That case has been on hold pending sentencing in Whalen's criminal case in New Jersey.

Many investors blamed Morris for the alleged fraud. He has denied any wrongdoing.

Morris left his job at Fox in 2017 to focus on his real estate advice company, Morris Invest. He teamed up with Whalen and his company, Oceanpoint, to market turnkey rental homes in Indianapolis, often to novice, out-of-state investors.

With his Fox News Channel background and popular YouTube channel, Morris was the face of the operation, often dealing directly with investors. Whalen, meanwhile, provided a steady stream of properties — many purchased at county tax sales — and provided repair and property management services.

But many investors claim Morris and Whalen failed to make repairs and in some cases created fake leases and sent bogus rental payments to hide the poor condition of the homes. One of the largest lawsuits, filed by a group of 13 investors in 2019, accused Morris of running a Ponzi scheme.

Morris and his family moved to Portugal a few months after IndyStar and The New York Times reported on the allegations in 2019. At that time, Morris blamed Oceanpoint for the problems and contended that he merely referred investors to Whalen's company.

While Whalen is the only one who has faced criminal charges, FBI interviews with investors and victim assistance letters to potential victims suggest Morris has also been a target. Whether that's still the case is unclear. The U.S. Attorney's Office in New Jersey declined to comment on the status of any investigation. Morris did not respond to emails and his attorney David Hensel, did not return messages.

Where is Clayton Morris now?

Since moving to Portugal, Morris has continued to operate Morris Invest , routinely posting YouTube videos and directing viewers to the company's website. The pitch is largely the same, but with a shift away from aging housing stock.

"Morris Invest builds new homes in the best rental markets and helps you finance, fill, and manage them," the website says. "Join hundreds of investors earning thousands in passive income each month."

Morris also started a new YouTube show called Redacted , which is described as "a look at the news the mainstream media largely ignores." He co-hosts the show with his wife, Natali Morris. It has nearly 2.5 million subscribers.

In one recent video , Morris discusses "evidence that a deep state group of thugs is running the United States government into the ground" and "stunning new details in the plot to assassinate President Trump and further evidence that President Biden is no longer in charge of the White House." The episode was funded by a company that profiles extremely risky penny stocks.

The show has been criticized for spreading conspiracy theories and misleading information about COVID-19 vaccines and the war in Ukraine . Videos include a disclaimer that says: "These videos are for entertainment purposes ONLY."

Morris also started a retro video gaming channel. It has about 50,000 subscribers.

Now, though, Morris and his family appear to be back in the United States after roughly five years abroad. An Aug. 6 YouTube video shows him shopping at a used video game store in Colorado.

"Just moved my family across the world and just got settled for the past week or so," Morris says.

Court records and interviews with investors suggest Morris has settled many of the civil lawsuits investors filed against him, but several investors told IndyStar they did not recover their full investments.

Brian Freeman, a California investor, said he was contacted by the FBI about a year ago about Morris, but hasn't heard anything since then. He purchased a home through Morris and received rent checks for about five months before a city inspector told him the home had been vacant for a long time and was infested with rats.

Freeman said he doesn't understand why Whalen remains free despite admitting to his crimes. So far, it doesn't seem like government investigations have resulted in any real consequences for either man, he said.

"The investors have been without their money for six years now," he said. "You’ve got one guy who pleaded guilty and another guy benefiting from the scam with no charges brought. It just blows my mind. How is that possible?"
