Current Status of VAT on Yacht Charters in Greece

Below is a brief description of the Current Status of VAT on Yacht Charters in Greece as per relevant Directives issued due to COVID-19 Measures Last year , the postponements and the return of the latest Directive as of 1/4/2021.

Please note that the following dates this will be cleared and we will soon be able to advise you on the accurate VAT Scheme in Greece for Yacht Charters during 2021.

February 10.2020 | Greece introduces VAT Directive A.1018/2020 

Canceling every previous legislation and introduces 3 VAT Brackets as follows which cover All Greek Flag Commercial Yachts and all Greek Licensed Yachts of any type size and use or use with (All according to LAW 4256/2014 As Amended).

Bellow VAT will be finalised before February of the following the charter year and for every charter to have the VAT Authority at the TAX Office specific requirements are requested to accompany the approval application in order to prove the 60% Factor (Example AIS Tracking / Log Book Copies etc).

Thus the installation of AIS to Greek Yachts became Compulsory | Directive Attached.

VAT Brackets

VAT 24 per cent full Greek charter rate – Applies to charters that take place  in Greek waters without exiting to non-EU or International waters  (Staying within the six miles limit)

VAT 24 per cent – With a deduction option for time spent outside of EU waters  or in International waters. This will take in to consideration all chartered days  in an accounting year.

Discounted at 50 per cent (VAT 12 per cent) – This will be for yachts that  spend a minimum of 60 per cent of charter time/days outside of territorial waters.  (Territorial waters are considered: six nautical miles from the mainland and six  nautical miles from the territorial waters of an Island). 

This also applies for yachts commencing charters outside EU territory and that  remain outside for more than 60 per cent of chartered days and end their charter in Greece.

In the same Directive Article 7 Paragraph 5 Introduces Commercial yachts (Not Greek Licensed )  entering Greece from Non Eu countries under charter should pay VAT for the days they spent in  Greek Waters at a rate of 24% 

The VAT will be paid by issuing TAX ID to the charterer through a fiscal representative.

May 21/05/2020 | Greece introduces POL A.1118/2020 which postpones A.1018/2020 and returns back to the following VAT Structure:

According to the instructions of the Ministry of Finance and the new support economic measures the following changes are noted.

For the period of 1/6/2020 up to 31/10/2020 VAT is reduced for the services of transport of people  and their luggage from 24% to 13%

According to the decision no. A.1118 exceptionally due to the emergency and unpredictable need for the dealing  with negative financial consequences connected to the appearance and spreading of coronavirus COVID-19 the decision  no. A.1018/2020 (G.O.G. B’ 361/7.2.2020) is suspended from its commencement, namely the  “Specialization  and proof of the criterion of use and exploitation in charters of professional pleasure yachts”. 

Since 24.4.2019 and henceforth for the specialization and the proof of the criterion of use and exploitation and  for the calculation of the taxable value in charters of pleasure yachts of l. 4256/2014, those mentioned in the  current legislation are applied proportionately up to 24.4.2019, according to the clarifications provided by  the D. 1156/1997. 

Therefore the former measure for the calculation of the VAT fares exemption returns depending on the boats category. 

More specifically the following are applied:

The VAT (13%) in the charter agreement of professional pleasure yachts is defined as follows:

  • Tourist ships that perform international trips beyond our territorial waters, when they approach foreign ports with proof are discharged from V.A.T.
  • Tourist ships that perform international trips beyond our territorial waters without proving their approach to a foreign port are entitled to a 60% V.A.T.  (category I) . Onwards and till 30.10  The VAT will be : 5,2 % .
  • Tourist ships that depart from a Greek port and perform trips of great navigation (i.e. Piraeus, Corfu, Northern Greece, Mytilini, Crete and Dodecanese) are subject to 50% VAT discount (category II). Onwards and till 30.10  The VAT will be : 6.5 %
  • Tourist ships that depart from a Greek port and perform trips of small navigation (i.e. Piraeus to Cyclades, Northern Sporades, Zante, Cephalonia, Corfu ) are entitled to 40% VAT discount (category III). Onwards and till 30.10.2020   The VAT will be : 7.8% 
  • Tourist ships that perform trips of limited range (i.e. trips from Piraeus to ports of Saronic and Argolic Gulf or from ports of N. and S. Euboean Golf  up to Volos or between ports within the Corinth Gulf up to Patras)  are subject to 13% VAT.

Where as TOURIST SHIP includes all Commercial Yachts of any type 

On march 29th of 2021 greece introduces pol a.1070/2021 which cancels pol a.1118/2020 which postponed pol a.1018/2020 and brings pol a.1018/2020 as of 1/4/2021..

So, as of 1/4/2021 Part (A) above is in force till further Notice.

Meetings for postponing POL A.1018/2020 have been held from different organizations and Unions on Friday 9/4/2021 during the first week of April with from one hand positive reactions  on behalf of AADE but nothing solid or any POL of postponement.

Thus, till further notice , Part A applies .

Greece introduces new VAT rules for charter vessels

Confusion remains over how greece will implement the system and whether it will be operational by summer 2020….

Greece’s new VAT rules are in accordance with the European Union’s directive and are the same rules that have been applied in both France and Italy. The new rule is based on the principle that VAT is charged at the full rate (24 per cent) for the time that the yacht is in EU waters, and no VAT is applicable while in international waters or non-EU waters. VAT will be applicable in the country where the charter begins.

However, there are subtle differences in how Greece has chosen to implement the changes which has raised questions over whether or not the new system will be actionable in time for the summer charter season. Furthermore, unlike France, there will be no stay of execution for charter contracts that have already been signed, meaning that a number of guests will be required to pay a higher rate of tax in the event that they continue with their charter plans.

“Initially this will effect both vessels chartering in Greece and vessel that are in possession of Greek charter licenses,” explains Chris Peacock, Ionian islands and Albania area manager for Evolution Yachting. “The idea is to link yacht's AIS systems to a government platform that will follow yacht movements and will, according to these movements calculate the VAT due. However, I have doubts that such a system will have much success, technical difficulties are bound to arise. For example, conflicting information from the yacht and the government platform, times when AIS systems on-board may be down, sheer number of vessels in the high season and possible privacy issues, may cause disruption to its implementation.”

There are three tax brackets to be implemented and they will be calculated as below:

  • VAT 24 per cent full Greek charter rate – Applies to charters that take place in Greek waters without exiting to non-EU or International waters (Staying within the six miles limit)
  • VAT 24 per cent – With a deduction option for time spent outside of EU waters or in International waters. This will take in to consideration all chartered days in an accounting year.
  • Discounted at 50 per cent (VAT 12 per cent) – This will be for yachts that spend a minimum of 60 per cent of charter time/days outside of territorial waters. “Non-Greek flagged/licensed yachts that intend on embarking and disembarking outside of Greek waters but will be passing through Greek territorial waters, such as Saranda Albania to Saranda Albania or Turkey to Turkey have to assume that 24 per cent VAT will be applied, this will be calculated on the full charter amount in accordance with days spent in Greek waters. However due to the technical difficulties mentioned above, at this present moment there is no clear instructions on how to collect or who will be responsible to collect this VAT),” continues Peacock.

“To many peoples’ disappointment these plans do not mean that the Greek cabotage laws will be abolished, embarking and disembarking in Greece without a Greek charter licence is still out of the picture.”

In the long-term it is hoped that the necessary Greek authorities will see the benefit of the new taxation system and will, accordingly, amend Greece’s prohibitive cabotage laws. Additionally, once all popular superyacht destinations within the EU apply the same laws as instructed by the EU’s directive, the market will have taken a large step towards the fiscal homogenisation that has been much lauded in recent years. However, it is more than likely that in the coming years certain nations will fail to implement the new directive in a practical and easy-to-understand way – a period of teething should be expected. Once the creases have been ironed out, however, we may see the emergence of a fairer charter market that is more reliant on merit than cost effectiveness and VAT savings.

Sometimes the phrase “It’s all Greek to me” applies to the confusing VAT on charter yachts.  Being informed is the key, and here is the clarification wording straight from the Greek Yachting Association.

“ Until the 31st of December 2022, the VAT rate on yachts that are of an overall length that is greater than 24 meters (based on their Certificate of Registry) or the LOA is below 24 m. but the vessel has a registered crew (it is not a bareboat), which will be 13%. The reduction from the normal 24% is due to the pandemic. Specifically: 1) For charters up to 2-3 days, the VAT is fixed at 13% 2) For yachts in possession of a “Protocol of General Inspection of Small Passenger Ship” for international cruises, a discount of 60% applies with the final VAT rate being 5,2%. 3) For yachts in possession of a “Protocol of General Inspection of Small Passenger Ship” for Greek waters cruises, a discount of 50% applies with the final VAT rate being 6,5%.”

I think this is particularly helpful in terms of understanding the 5.2 and 6.5%.

VAT increase on luxury yacht charters in Greece

The Greek yachting industry is urging potential charterers not to be put off visiting the country despite an increase in VAT.

The amount of tax to be paid on luxury yacht charters in Greece has risen from 13% to 23% thanks to a wider 10% VAT increase introduced as part of new austerity measures in the country. The Greek Yachting Association (GYA) has now confirmed that the new rate of VAT is “due for all charters executed in Greece from July 20 onwards, irrespective of the date the charter contract was signed”.

The amount of extra VAT to pay will depend on the vessel being chartered. For charters that last three days of more superyachts will fit into two categories that will offer a discounted rate.

Vessels that are “entitled to perform international cruises” will have 60% discount. This means that the VAT rate will only be 9.2%, still a 4% increase. Meanwhile “vessels entitled to perform long range cruises within the Greek waters” will have a 50% discount. Therefore the new VAT rate for this category will rise to 11.5% from 6.5%.

There is no discount for cruises that are less than 48 hours so therefore the full 23% VAT rate will have to be paid.

Despite financial uncertainty in the country the industry has worked hard to ensure that it has remained "Business as usual" for Greek luxury yacht charters .

President of the GYA and CEO of Atlanta Golden Yachts Michael Skoulikidis told Boat International that this latest VAT increase was “not alarming”.

“Even after the recent rise, the VAT level in Greece remains similar to that of many European countries,” Skoulikidis said. “It is not an alarming increase or one that is out of the boundaries of market reality. Furthermore, I believe that what is important when chartering a yacht, is to see the whole picture and the final cost. VAT should not be considered in isolation but one should assess the total cost, the quality of the services provided and the destination

“Despite the rise in VAT, charters in Greece are still competitively priced and there is absolutely no reason for anyone to be put off from visiting Greece.”

Michel Chryssicopoulos from Cape 4 Yachting agreed that it was important to see the rise in comparison to the total cost of chartering a luxury yacht.

“The increase in the VAT for charter yachts is reasonable and expected. Greece is now in line, or still even more competitive, than most ‘popular’ European destinations,” he said.

“In the big scheme of things, paying an additional 5% is not optimal, but it should not change a client’s decision whether to charter or not in a beautiful destination like Greece.”

What is Yacht Charter VAT?

Charter VAT (Value Added Tax) is a tax applied to the cost of renting (or chartering) a yacht in certain countries. The VAT rate can vary, ranging from 0% to 24% , depending on the country where the yacht charter begins, its duration, and whether the yacht travels in domestic waters, international waters, or a combination of both.

For example, Greece has a standard VAT rate of 24%, but this drops to 12% for charters over 48 hours. The VAT can be further reduced under special circumstances, for example, if the yacht spends a significant amount of time outside of Greek waters.

Why Are Yachts Listed Excluding VAT?

Charter Yachts are listed excluding the VAT (Value Added Tax) because the amounts differ from yacht to yacht and might even be different for an individual yacht within the season. Please inquire and we will provide specific details of the yacht and dates.

When Do I Pay the Yacht Charter VAT?

VAT is paid along with your final charter fee, typically one month before the start of your trip. This payment is managed by the Fiscal Agent, ensuring everything is taken care of in advance.

After signing the charter contract and before boarding, you’ll need to make a few payments: the charter fee, Advanced Provisioning Allowance (APA), VAT, and sometimes additional fees like delivery or security deposits. There are no unexpected costs; everything is clearly outlined in your agreement. Does My Itinerary Effect My Yacht Charter VAT?

VAT (Value Added Tax) is generally tied to the location where your yacht charter begins, regardless of where the itinerary takes you afterward. This means that the VAT is due to the authorities of the country where the charter starts, and the rate is based on that country’s regulations.

Example Explanation:

If you start your yacht charter in Antibes, France, you are obligated to pay VAT to the French authorities, even if your journey ends in a different country, such as Dubrovnik, Croatia. The VAT is calculated according to the French VAT rate because the service (the yacht charter) was initiated in France.

Do I Have to Pay VAT on the APA?

VAT is only charged on the base charter price, not on the Advance Provisioning Allowance (APA). However, for all-inclusive charters, VAT is calculated on the entire cost of the charter, which includes all services and provisions. This setup is especially beneficial for clients who have previously chartered an all-inclusive catamaran in the Caribbean.

  • Yacht Type and Size: For crewed yacht charters in Greece, the base charter fee starts at around €10,000 per week. But from there, the range is wide -it really depends on the yacht type: Is it a motor yacht, catamaran, or sailing yacht? How big is it, and what is the level of luxury?
  • The APA ( Advance Provisioning Allowance ): The APA is usually a set percentage of the base charter fee (25-40% in Greece, depending on yacht type) -lower for sailing yachts and higher for motor yachts due to higher fuel consumption.
  • The Greek Charter Tax (VAT): The VAT on yacht charters in Greece typically starts at 24%, but reductions can lower it significantly, depending on the charter’s duration. What is Covered in the Charter Fee?

Many crewed charters in Greece follow a ‘plus-expenses’ pricing structure . This base charter fee typically includes the cost of the yacht rental for the agreed period, the full crew, and access to all water sports toys and equipment onboard.

However, additional expenses such as food, drinks, fuel, crew tips, and docking fees are not included in the base price. These extra costs are covered through an Advance Provisioning Allowance (APA), which is a deposit paid before the trip to cover these additional expenses.

What is Advance Provisioning Allowance (APA)?

The Advance Provisioning Allowance (APA) is a budget additional to the base yacht charter fee set aside in a separate APA account. The APA covers costs like fuel, food, drinks, port fees , and any other miscellaneous expenses that occur during the yacht charter.

APA is a standard practice in Mediterranean crewed luxury yacht charters. On all yachts operating under   MYBA terms, the APA amount is outlined in the charter agreement and is usually set at around 25-40% of the base charter fee.

In the Caribbean, charter fees are often all-inclusive , meaning the APA is already calculated into the total charter price.

The idea of the APA is to have a fund that the yacht captain can use to provision the boat according to your preferences and needs without needing to clear every expense with you during the trip. At the end of the charter, the captain will provide an itemized list of all expenditures , and if the Advance Provisioning Allowance exceeds the costs, you will get a refund of the difference . If the costs exceed the APA, you’ll need to pay the extra amount.

How Much Should I Tip the Crew?

When it comes to tipping crew members on a yacht charter, the general guideline is to offer a gratuity that reflects the quality of service provided.

Typically, tips range from 5% to 15% of the total charter fee , depending on the location and the customary practices there. For example, in the Mediterranean, it’s common to tip towards the lower end of this range, while in the US and Caribbean, gratuities at the higher end are more typical.

All crew members usually share in the gratuity, regardless of their specific roles, as they all contribute to the overall experience of the charter. It’s customary to hand the total tip to the captain , who will distribute it among the crew.

Payment is generally made at the end of the charter, and while cash is often preferred , other arrangements can sometimes be made through your charter broker or by other means agreed upon.

The expected tip can also be influenced by the type of yacht and the level of luxury and service provided. High-end luxury yacht charters expect higher tipping, reaching up to 30% , reflecting the elevated service level.

  • Pick a yacht with good fuel efficiency: Newer yachts typically have newer engines and much better fuel efficiency. This can make a huge difference at the end of a one-week charter. If you really want to save on fuel, choose a catamaran or a sailing yacht and take advantage of the wind!
  • Split the bill:  A really good way to get down your yacht charter spending without compromising on luxury is to share your yacht charter with a group of friends or family. Lots of yachts these days are set up for multiple couples, with 4-5 cabins for 10-12 people, large dining areas, and water toys enough for a whole team.
  • Don’t be over ambitious: Lots of charter guests come with a big wish list of places to see while on their charter. But in reality, it is not nice to be on the move all the time. Choosing shorter distances will save you serious dollars on fuel!

YACHT CHARTER TAX FAQS

How is vat applied to a superyacht charter.

In general, VAT is applied to the full charter fee and then determined by the VAT rate of country in which the charter begins. For example, if your charter starts in France and ends in Italy, you will pay VAT to the French authorities. VAT is also, subject to location, applied to delivery and/or redelivery fees.

Although this may sound like a somewhat confusing and lengthy process, your Ocean Independence Charter Consultant will guide you through every step of the booking process. VAT amounts due will be clearly presented on page one of your MYBA Charter Agreement with further explanation of the VAT applied to your charter in the ‘Special Conditions’ or a VAT Addendum attached to the agreement.

WHEN DO I PAY THE VAT?

VAT is paid in your final instalment of charter fees due, usually one month prior to the start of the charter and held in the stakeholder’s client account before being dispersed to the Fiscal Agent.

Put simply, after you have signed the charter contract, but prior to boarding, you will be required to make a number of payments which include the charter fee, the Advanced Provisioning Allowance (APA), VAT, and sometimes also (re)delivery fees or security deposits.

But rest assured, there are no last-minute surprises. All payments are pre-empted and specified in your charter agreement. CAN I QUALIFY FOR REDUCED VAT?

In some cases, time spent cruising outside of EU waters during your charter can be proportionately reduced with any excess VAT reimbursed at the end of the charter. However, for small amounts of time spent outside EU waters, any VAT advantage may be negligible once fuel costs are taken into account.

VAT RATES FOR CHARTERS IN EUROPE

FRANCE (INCLUDING MONACO) AND ITALY

January 2020 signalled significant changes in the ways that VAT was applied to superyacht charters (although there were some delays in putting these into effect due to the Covid-19 pandemic).  The current situation for charters starting in Italy, France and Monaco is that VAT is now applied at the country’s full VAT rate at the origin of the charter, i.e. the port of embarkation.

This VAT rate is applicable regardless of which country your port of disembarkation falls in. VAT is also applied to any delivery or redelivery fees.

For itineraries including both France and Italy, VAT will always be applied at the rate of the country of origin, i.e. if starting in France or Monaco – 20%, if starting in Italy – 22%.

FRANCE AND MONACO

In France and Monaco, the standard rate of 20% French VAT is due on charters, and (re)delivery fees originating in France and in Monaco, regardless of the port of disembarkation.

For itineraries including significant time spent cruising outside EU waters, your Captain will calculate the actual hours in international waters and the tax is proportionately reduced. At the end of the charter, you will be reimbursed via your Charter Consultant.

As of June 2020, modifications to Italy’s Value Added Tax (VAT) regulation were implemented, enforcing a standard rate of 22%. VAT in Italy is required to be paid on the charter fee along with any fees for delivery/redelivery that originate in Italy, irrespective of the port of departure.

The previously available lower VAT rate of 6.6% for itineraries entering international waters is no longer applicable. However, as with France, for any itineraries including significant time outside EU waters, the taxable base is reduced, and a reimbursement of VAT paid may apply following the conclusion of the charter.

For all charters starting in Spain, VAT is set at a standard rate of 21% of the charter fee. There is no reduction of VAT if cruising outside EU territorial waters (i.e. more than 12 nautical miles offshore) during the charter period. However, if starting outside the EU and cruising into Spain, VAT is only due on the number of days spent in Spanish waters.

Charters beginning in Croatia incur a VAT rate of 13% on the charter fee. However, VAT is not due on delivery and redelivery fees. If your charter begins outside of EU waters, Croatian VAT is due on a pro-rata basis, considering the number of days spent in Croatian waters.

Every yacht cruising in Greece is required to possess a Greek charter licence. And while the base rate of VAT is 24%, in most cases this is reduced by 50-60% depending on your itinerary.

One of the most recent changes to VAT in Europe, as of summer 2023, Turkey has increased its VAT rate from 18% to 20%. For charters in Turkey, on Turkish-flagged commercial vessels, 20% VAT is applied to the charter fee.

For foreign flagged commercial vessels chartering in Turkey VAT is 0%. But it’s essential to note that while vessels under 39 metres are required to purchase a cruising permit, it is mandatory for yachts over 39 metres to obtain a Turkish Charter Licence.

As costs may vary depending on the size of your charter yacht and the length of your stay, should you require clarification or detailed information on the cost of a cruising permit for your chosen yacht and itinerary,  your Ocean Independence Charter Consultant  is readily available to assist.

In Montenegro VAT is 0% so you will not incur any VAT charges while chartering a superyacht here. However, if your itinerary extends into Croatia, you will be required to pay Croatia’s VAT rate of 13%, levied pro rata for every day you stay in Croatian waters.

VAT ON YACHT CHARTERS IN THE BAHAMAS

While the VAT rate for superyacht charters in most of the  Caribbean  is currently 0%, the Bahamas introduced a 10% VAT from the 1st of July 2022. As a result, foreign-flagged yachts chartering in Bahamian waters are now required to pay this rate on the charter fee. Additionally, July 2023 saw another significant increase in the cost of charter licensing (paid by yacht owners annually).

Prior to the recent introduction of this VAT rate,  Bahamas yacht charters  had a mandatory 4% port tax. This tax remains in place, resulting in a total tax rate of 14% of the charter fee.

The “e-CharterPermission Plus” is granted online and refers to the permit that a Commercial Yacht over 35 meters (NON WOODEN – NON GREEK FLAG) to either Embark its Passengers In Greece and Disembark them abroad or embark its passengers abroad and disembark them in Greece. There is no limitation of how many times a yacht will enter or exit from Greece nor any length of stay within Greek Territory provided that it will use 28 days in Greece . There is no VAT on this Charter however an Administrative Fee will be Charged.

The e-CharterPermit is Granted online and is compulsory to fulfill the below requirements :

Example: If you have a Commercial Yacht 15 meters and plan to visit Greece for 5 days then you will need to apply through our agency and through a very easy process you will be able to get the permit to enter Greece . If for example you plan to stay ion Greece 5 days The Total Fee to be paid is € 920 Above fee is only the CharterPermit to Cruise in Greek waters . There are other fees to be calculated as well such as Entry Formalities , TEPAI , Agency service and Marina Fees .

Conditions precedent:

  • yacht registered under a EU-flag with the authorization by the Flag-State to be chartered;
  • the Operator must (1) establish a physical branch in Greece , (2) be VAT registered in Greece and (3) obtain a Greek charter licence;
  • the Operator has to name a fiscal representative and to register the yacht in the Greek charter yacht register;
  • there is the obligation to have the yacht chartered with a minimum of  200 days over a 5 years reference period.
  • The applicable rate is 24%, but reduced to 9,6% for foreign yachts entitled to perform international cruises for charter parties upon 3 days
  • duration and starting in Greece;
  • There is no Greek VAT to be paid for charter parties starting from other EU-member states, but the yacht must obtain a “Dilkito” from the authorities of the first port of entry and no change in the passengers list is allowed;
  • Greek VAT applies in prorate basis in time for charter parties coming in from non EU countries.

Tax-free fuel:

  • available for crewed yachts under the condition to be chartered at least 75 days during an 3 years reference period.

  • VAT status for EU and non-EU yachts in Greece

There are three options regarding the VAT of the vessel: I) If the vessel will be acquired by an EU individual or legal entity, not having commercial activity , the applicable VAT will be calculated on the purchase price of the vessel and has to be paid by the Buyer. II) If the vessel will be acquired by an EU individual or legal entity, having commercial activity and having been registered for VAT purposes in its state, the transaction will be considered as an intra-community transaction and the possible obligation for the payment of the VAT will be transferred to the Buyer. He will have to deal with the payment or not of the VAT in his country. III) If the buyer of the vessel will be a non EU individual or legal entity (US, Russian, Japanese etc) no VAT will be calculated and paid as the transaction will be considered as an exportation out of EU. In that case only a small tax declaration for exporting the boat out of EU has to be paid by the buyer.

New regulation on yachts chartering in Greece to go ahead

A ministerial decision has led to new regulations being put in place which may limit the flexibility of yacht charters in Greece .

Last month, a decision was made by the Greek government stating that foreign-flagged yachts chartering in Greek waters will need to spend more than 50 percent of their distance travelled while chartering in the open seas in order to benefit from VAT exemptions.

This comes after a decision was put in place last year, stating that foreign-flagged yachts wishing to begin or end a charter in Greece would need to go through the arduous process of obtaining a Greek charter licence.

If these specifications are not met, yacht-owners will not be able to benefit from VAT exemptions on fuel, provisions and equipment while their yachts are chartering. If not adhered to, yachts could be subject to a VAT liability, arising on the value of the hull.

The clampdown may lead to yachts being deterred from chartering in the region, according to Jennifer Timinis, communications director of Greek yacht agency and management company Oceda.

“ ‘The open seas’ is defined as six nautical miles away from the coast,” explains Timinis, “but in Greece, there are so many islands, it’s very difficult to spend 50 percent of total charter distance travelled in open seas.”

“At the moment, it doesn't look like simply entering open seas will suffice to comply with regulations." She continues. "Yachts have to literally spend 50 percent of cruising time in those waters."

Under the new regulations, all owners wishing to benefit from VAT exemptions will have to use AIS to keep full records of all charter movements. They can then be inspected by authorities to ensure their yachts are complying with the rule.

"There are still too many grey areas to be able to give clear advice and we are still awaiting more input from the government on how such regulations will actually apply.” Says Timinis.

The decision was made by the Greek government, which has been under pressure by the EU to limit tax exemptions on vessels which are available to charter. “The EU has pushed for this, but I don’t think our government did a good job at fighting it." says Timinis.

"I think they probably saw it as a good opportunity to cash in from the yachting industry, which unfortunately is dreadfully short-sighted."

As seasoned charterers will know, the Greek charter market has always operated differently compared with the rest of Europe. Regulations in France, Italy, Spain and Croatia are more flexible, and involve a simple VAT registration for foreign-flagged yachts chartering in their waters.  "Each EU country is more or less on the same page except for Greece,” confirms Timinis.

“It’s almost as if the [Greek] people advising the government aren’t really part of the industry, they don’t understand how the rest of Europe works. If they did, we would just mirror their procedures, with clear-cut rules in place which would allow the local market to flourish." Says Timinis.

“The current system in place is so complicated that as a result, foreign-flagged boats do not bother with the Greek charter licence and simply start and end charters outside of Greece, meaning the country misses out completely on that VAT - let alone fuel, provisions and other supplies which would normally be delivered at the start of a charter. "

It will take some time before grey areas are clarified and the regulations are put in effect. Until that time, Timinis says we can expect some intense lobbying from yacht-owners and the local market.

“It’s a shame because Greece has 6,000 islands and islets in total, so you have unrivalled cruising diversity. You have Mykonos and Santorni if you want to do the whole shops, clubs, restaurants, bars thing, and then you have the milder, but still lively, islands to choose from - and then you have the more remote islands, with stunning scenery and secluded bays. Green islands, barren islands, whitewashed islands, - you have everything.” Says Timinis.
